SHC lets go the FPCCI election process on 30 December


A division bench of Sindh High Court has allowed to continue the process of annual elections by Federation of Chambers of Commerce & Industry (FPCCI) according to its schedule on 30th December 2021, and fixed next date of hearing on 19-01-2022 for petition filed against it.

The bench comprising Chief Justice Ahmed Ali M. Shaikh and Yousuf Ali Sayeed ordered to include the name of petitioner Muhammad Hanif Gohar as a candidate but withheld his result only in case being a winner till final judgment of this petition. Earlier, on 10-12-2021 the court had suspended operation of the orders issued by DGTO and the Election Commission of FPCCI.

The Election Commission had passed the order dated 23-11-2021, rejecting the nomination of the petitioner and his name was excluded from the provisional list of voters for the FPCCI elections for the year 2022. The order passed by the Election Commission held that Mr. Gohar’s Company namely Gohar Construction Company (Pvt) Ltd. was not registered with ABAD in the year 2020 and had not completed its two years (24 months) of membership, hence the said nominee does not qualify to be nominee as he has not completed the required period of two years of his membership.

The petitioner challenged the decision dated 23-11-2021 passed by the Election Commission before the DGTO for excluding the name of the petitioner from the voter list. But the DGTO dismissed the said appeal through its order dated 03-12-2021 and upheld the decision passed by the Election Commission.
